International Treaty Making on Special and Differential Treatment in the WTO
Outline
The WTO is based on the principles of non-discrimination and reciprocity among its members. However, preferential treatment has been granted to developing countries with the concept of “special and differential treatment (S&D).” S&D has the important function of providing institutional support to developing countries for their gradual participation in the WTO system. Currently, developing countries are not given enough specific preferential measures that they seek. For this reason, developing countries have been advocating the conclusion of an agreement on S&D with the aim of strengthening the functioning of S&D, but discussions have not progressed very far. This study aims to examine why there has been no progress in making S&D treaties from the perspective of the legal binding nature of S&D.
