Environmental Remediation and Law in China: Issues in Theory and Practice

Outline

In China, under the recognition that environmental pollution and the degradation of natural environments have reached a tipping point, "environmental remediation" has emerged as one of the main objectives of the country's new environmental governance, aimed at improving and rehabilitating environmental quality. To enforce environmental restoration as a legal responsibility of polluters, existing legal frameworks have been utilized alongside new mechanisms such as litigation and negotiations. However, practical challenges remain, particularly regarding the management of restoration costs, ensuring the execution of restoration, and evaluating its effectiveness. Moreover, the rapid development of legal frameworks has, in many respects, resulted in inconsistencies and disconnections with established legal theories and principles. This research project aims to provide a comprehensive overview of the legal systems that have been developed around "environmental remediation" and to identify the practical issues that have emerged through case studies, while also depicting the ongoing legal debates surrounding these issues.
